1. GENERAL PROVISIONS

1.1.

The Online Store available at www.labcar.net is operated by SEBASTIAN SZYMAŃSKI, conducting business under the name LABCAR SEBASTIAN SZYMAŃSKI, entered in the Central Register and Information on Economic Activity of the Republic of Poland, maintained by the minister competent for economy.

1.2.

These Terms and Conditions are addressed both to consumers and entrepreneurs using the Online Store, unless a specific provision states otherwise and is addressed exclusively to consumers or entrepreneurs.

1.3.

The controller of personal data processed in connection with the implementation of these Terms and Conditions is the Service Provider. Personal data is processed for the purposes, within the scope and on the basis of the rules indicated in the Online Store Terms and Conditions.

Providing personal data is voluntary. Every person whose personal data is processed by the Service Provider has the right to access their data and the right to update and correct it.


1.4. Definitions

BUSINESS DAY – one day from Monday to Friday, excluding public holidays.

REGISTRATION FORM – a form available in the Online Store that enables the creation of an Account.

ORDER FORM – an Electronic Service, an interactive form available in the Online Store that enables placing an Order, in particular by adding Products to the electronic cart and specifying the terms of the Sales Agreement, including delivery and payment methods.

CUSTOMER – a natural person with full legal capacity, and in cases provided for by law also a natural person with limited legal capacity; a legal person; or an organizational unit without legal personality to which the law grants legal capacity, who has concluded or intends to conclude a Sales Agreement with the Seller.

CIVIL CODE – the Polish Civil Code Act of 23 April 1964.

ACCOUNT – an Electronic Service, a set of resources in the Service Provider’s ICT system marked with an individual login and password provided by the Service Recipient, where data provided by the Service Recipient and information about their Orders are stored.

NEWSLETTER – an Electronic Service provided by e-mail, enabling users to automatically receive periodic content from the Service Provider, including information about Products, news and promotions in the Online Store.

PRODUCT – a movable item available in the Online Store that is the subject of a Sales Agreement between the Customer and the Seller.

TERMS AND CONDITIONS – these terms and conditions of the Online Store.

ONLINE STORE – the Service Provider’s online store available at www.labcar.net, operating on the PrestaShop platform.

SALES AGREEMENT – a sales agreement for a Product concluded or to be concluded between the Customer and the Seller via the Online Store.

ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Online Store.

SERVICE RECIPIENT – a natural person, legal person or organizational unit without legal personality that uses or intends to use an Electronic Service.

CONSUMER RIGHTS ACT – the Act of 30 May 2014 on consumer rights.

ORDER – a declaration of will submitted by the Customer via the Order Form, aimed directly at concluding a Sales Agreement for a Product with the Seller.


2. ELECTRONIC SERVICES IN THE ONLINE STORE

2.1.

The following Electronic Services are available in the Online Store: Account, Order Form and Newsletter.

Account – using the Account is possible after the Service Recipient completes three steps:

  1. filling in the Registration Form,
  2. clicking the “Create account” button,
  3. confirming the intention to create an Account by clicking the confirmation link automatically sent to the provided e-mail address.

The Registration Form requires the Service Recipient to provide the following data: first and last name / company name, address, e-mail address, contact phone number and password. In the case of Service Recipients who are not consumers, it is also necessary to provide the company name and tax identification number.

The Account Electronic Service is provided free of charge for an indefinite period. The Service Recipient may delete the Account at any time and without giving any reason by sending an appropriate request to the Service Provider, in particular by e-mail to labcar@labcar.pl or in writing to: ul. Jana Kilińskiego 146, 24-100 Puławy, Poland.

Order Form

Using the Order Form begins when the Customer adds the first Product to the electronic cart in the Online Store.

An Order is placed after the Customer completes two steps:

  1. filling in the Order Form,
  2. clicking the “Confirm purchase” button after completing the Order Form.

Until this moment, the Customer may independently modify the entered data by following the messages and information displayed on the Online Store website.

The Order Form requires the Customer to provide the following data: first and last name / company name, address, e-mail address, contact phone number, and details concerning the Sales Agreement: Product(s), quantity of Product(s), place and method of delivery, and payment method.

In the case of Customers who are not consumers, it is also necessary to provide the company name and tax identification number.

The Order Form Electronic Service is provided free of charge, is one-time in nature, and ends when the Order is placed through it or when the Service Recipient stops placing the Order before completion.


Newsletter

Using the Newsletter begins after entering an e-mail address in the “Newsletter” section visible on the Online Store website and clicking the “Subscribe” button.

The Newsletter may also be subscribed to by ticking the appropriate checkbox when creating an Account. Upon creation of the Account, the Service Recipient is subscribed to the Newsletter.

The Newsletter Electronic Service is provided free of charge for an indefinite period. The Service Recipient may unsubscribe from the Newsletter at any time and without giving any reason by sending an appropriate request to the Service Provider, in particular by e-mail to labcar@labcar.pl or in writing to: ul. Jana Kilińskiego 146, 24-100 Puławy, Poland.


2.2. Technical Requirements

The technical requirements necessary to use the ICT system operated by the Service Provider are:

  1. a computer, laptop or other multimedia device with Internet access,
  2. access to e-mail,
  3. an internet browser: Mozilla Firefox version 11.0 or higher, Internet Explorer version 7.0 or higher, Opera version 7.0 or higher, Google Chrome version 12.0.0 or higher,
  4. recommended minimum screen resolution: 1024×768,
  5. cookies and JavaScript enabled in the internet browser.

2.3. Rules of Use

The Service Recipient is obliged to use the Online Store in accordance with the law and good practices, with respect for personal rights, copyrights and intellectual property rights of the Service Provider and third parties.

The Service Recipient is obliged to provide data that is true and accurate.

The Service Recipient is prohibited from providing unlawful content.


2.4. Complaint Procedure for Electronic Services

Complaints related to the provision of Electronic Services by the Service Provider and other complaints related to the operation of the Online Store, excluding the Product complaint procedure described in section 6 of these Terms and Conditions, may be submitted by the Service Recipient, for example:

  1. in writing to: ul. Jana Kilińskiego 146, 24-100 Puławy, Poland,
  2. electronically by e-mail to: labcar@labcar.pl.

It is recommended that the Service Recipient include in the complaint description:

  1. information and circumstances concerning the subject of the complaint, in particular the type and date of the irregularity,
  2. the Service Recipient’s request,
  3. contact details of the person submitting the complaint.

Providing the above information will help and speed up the complaint handling process. These requirements are only recommendations and do not affect the validity of complaints submitted without the recommended complaint description.

The Service Provider shall respond to the complaint promptly, no later than within 14 calendar days from the date of its submission.


3. TERMS OF CONCLUDING THE SALES AGREEMENT

3.1.

The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order using the Order Form in the Online Store in accordance with section 2.1.2 of these Terms and Conditions.

3.2.

The Product price displayed on the Online Store website is given in Polish zloty and includes taxes.

The Customer is informed on the Online Store website during the ordering process, including at the moment of expressing the will to be bound by the Sales Agreement, about the total price of the Product including taxes, delivery costs, transport fees, postal service fees and any other costs. Where the amount of such fees cannot be determined, the Customer is informed about the obligation to pay them.

3.3. Sales Agreement Conclusion Procedure

The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order in the Online Store in accordance with section 2.1.2 of these Terms and Conditions.

After the Order is placed, the Seller immediately confirms receipt of the Order and accepts it for processing. Confirmation of receipt and acceptance of the Order is sent by e-mail to the address provided by the Customer during the ordering process.

This e-mail contains at least the Seller’s statement confirming receipt of the Order, acceptance of the Order for processing, and confirmation of the conclusion of the Sales Agreement.

The Sales Agreement between the Customer and the Seller is concluded when the Customer receives the above e-mail.

3.4.

The content of the concluded Sales Agreement is recorded, secured and made available to the Customer by:

  1. making these Terms and Conditions available on the Online Store website,
  2. sending the Customer the e-mail referred to in section 3.3.

The content of the Sales Agreement is additionally recorded and secured in the Seller’s Online Store IT system.
